Interests of the colonial regime coupled with population growth, agricultural commercialization, urbanization, and demand for new land use patterns and practices have increased land conflicts in Kenya contributing to violence and disruption of societal systems.
Land conflicts have also been caused by individual greed and disagreements among members of the family, fraud, poor land registration system, high value attached to the land, territorial expansion linked to politics, corruption, and commercialization of farming activities.
Land conflicts and related crimes have a devastating impact on individuals and the economy. The Ministry of Lands reported 7,052 cases of property fraud in 2017, resulting in an annual cost to the economy of Sh60 billion. According to the Justice Needs and Satisfaction in Kenya Survey by The Hague Institute for Innovation of Law, land disputes affect between 2.4 and 2.8 million Kenyans.
These conflicts have resulted in injuries, loss of life and property, displacement of people, demolitions of illegal structures, rise of informal settlements, land grabbing, encroachment of private and government land reserves, ethnic animosity, increased fake title deeds, and court cases. They also hinder the smooth implementation of activities that support the economic development of the country, causing further delays and derailing progress.

Blockchain provides a potential solution for many of the challenges of land registration around the world. This use case for blockchain extends beyond a pure database, leveraging the opportunity to create a permanent, unbreakable record of ownership for land and or real estate.
Blockchain replaces outdated paper deeds with true digital assets and tracks changes on an immutable ledger that acts as a secure shared source of truth for documents between multiple parties and organizations.
A blockchain-based system provides transparent information on rental value, payment frequency, tenant and property history, and contractor agreements. It also facilitates secure data sharing, streamlines rental collections and payments to property owners, and also provides premium due diligence across the portfolio.
Tenant and investor identities from mutualized blockchain-based KYC/AML procedures can streamline background checks, reduce costs, and increase security. Decentralized identities enable anyone to prove ownership of properties while making essential documents (proof of insurance, identity, credit history) easily shareable with necessary parties.
Real estate tokenization converts the value of real estate into a token stored on a blockchain, enabling digital ownership and transfer. These divisible tokens each present a fractional share of ownership stake in that real estate.
Benefits of Real Estate Tokenization are increased transparency, ability to create liquidity, low barrier to entry and lower transaction costs.
